Under section 303(d)(1)(A) of the Federal Clean Water Act (33 U.S.C. § 1313(d)(1)(A)) requires states to create a priority ranking for waterways that require Total Maximum Daily Load (TMDL) development. This priority ranking must include the cause of the impairment and take into account both the severity of the pollution and the uses to be made of the waterbodies. To meet this requirement, the Department of Environmental Protection’s (Department) TMDL program has developed a draft TMDL prioritization strategy for the United States Environmental Protection Agency’s (EPA) 2022—2032 Vision for the Clean Water Act Section 303(d) Program (Program). This draft TMDL prioritization strategy will help guide the Department’s selection of specific waterbodies for plan development on a 2-year cycle in accordance with40 CFR 130.7(b)(4) (relating to total maximum daily loads (TMDL) and individual water quality-based effluent limitations). Interested persons may submit comments through Monday, April 22, 2024. Comments, including comments submitted by e-mail, must include the commentator’s name and address. Commentators are encouraged to submit comments using the Department’s online eComment tool at www.ahs.dep.pa.gov/eComment.
